Activision has been dealing with the anger of Guitar Hero III owners, which culminated four months ago in a class action lawsuit. The plaintiff, Sam Livingston, filed the suit against Activision because of the company's "deceptive" conduct regarding the lack of Dolby Pro Logic II.Instead of letting the case get to court, though, Activision decided to offer a settlement. The amount of cash that exchanged hands in the deal was not made public, but we bet a check will be more satisfying than a complimentary faceplate. Oh, and speaking of those? They were actually less of an act of kindness on Activision's part, and more of a required legal stipulation from the settlement.
Even though Activision probably lost a whole lot of pennies in order to settle, we're sure the company is happy that there's now one less lawsuit to worry about this year.

you better send it in soon or you wont get a replacement at all. the ones in stores already have the new disks in them, so you should be fine. send in your old disk for a new one.

I sent my disc in as soon as I read the news on this site. I got my replacement disc in 3 weeks, which was slightly faster than I had anticipated. I also received my faceplate a couple of weeks ago. The entire process was as smooth as could be expected.
I am such a Guitar Hero Fanboy that I am completely willing to forgive any malfeasance on Activision's part. I have GH: Aerosmith preordered and I am even contemplating getting GH: On Tour for DS (depending on reviews).
I'm confident that Activision is doing the best job that they can to satisfy their customers. There are some companies out there who are actively trying to screw over their customers or just don't care about doing so. This whole ProLogic 2 foul-up is probably the result of simple human error and their future projects will be better assuming that they learn from their mistakes.

At least they got to clean their warehouses out of all the unsold faceplates at the same time.

I sent my game in mid February and I haven't gotten anything from them yet. According to the status site it was shipped the 28th of February, but I still have yet to get it. I have emailed and called them with nothing but generic "We'll look into it" responses. I better receive a faceplate for all this hassle.

Craptivision probably just paid the people off, or were forced to offer the $132 refunds as part of the settlement.
If the faceplate was part of it too, it just goes to show how much they "care". They had to be FORCED to send it.
They don't care obviously. If they won't even send you your new disc faster than "3-4" weeks. Why can't they do a "pre-ship" swap out like any decent vendor does?
They just don't care.
How much they care is also obvious by the incompetent people they let QA & sign off on the game to even be released. How do they not notice that the ENTIRE game was missing the proper audio? Not just a song or two, but the ENTIRE set list.
Pure incompetence on someones part, not just a "simple mistake".
I did send my disc in though, and got mine back in only two weeks though, so at least it went smooth for me. Meanwhile I played my 2nd copy, which I now have to return for the $132.
The faceplate is useless though, I already have something I like better.
Where can I trade this POS in for DLC? Where IS the damn DLC?
The newer stereo disc was well worth it.
At least they got it right.
I will be getting the DS game, and GH:A as well, but probably buy an xbox 360 before then so I can get GH:2 also, and have DLC available already, and not have to wait for these idiot companies to get off their ass and get Wii DLC available.
The Wii Rock Band mockery just adds to the reasons for getting a 360.
I don't understand why Nintendo is being so stupid in not getting these 3rd parties to announce DLC for these games once WiiWare is out (for the US at least). They are just losing $$$, and customers.
It is obvious that the Wii's success has short sighted them severely about this stuff.
